Amendments

There are different processes for requesting an amendment of or raising a dispute regarding an entry in the Register.

The process to be followed will depend on whether the tartan has been registered with the Scottish Register of Tartans since 5 February 2009 or if it was recorded by the Scottish Tartans Society (STS), the Scottish Tartans World Register (STWR) or the Scottish Tartans Authority (STA) prior to that date and whether the request relates to a tartan you registered or if it was registered by someone else.

Requesting an amendment of or raising a dispute regarding a tartan registered since 5 February 2009

Under the Scottish Register of Tartans Act 2008 anyone may request the Keeper to amend or correct and entry on the Register.

Where the request relates to a tartan you registered -

If you are the registrant (the person who submitted the application to register the tartan which you wish to amend) then you will be able to request an amendment once you have logged into your Tartan Register user account. From your user account you will be able to link to the 'request an amendment form' in which you need to specify the amendment(s) required and why you are requesting the change(s).

If you wish to amend an entry made on behalf of a third party (individual or group) then you must have written consent of the third party to the proposed amendment and you may be asked to submit a copy of this evidence to the Keeper.

Where the request relates to a tartan registered by someone else -

You should fully explain your reasons for the request including what you would like to be changed. Your request will be referred to the registrant and the substance of their response shared with you before the Keeper decides whether or not to implement the requested amendment.

In all cases -

You may not request an amendment to the threadcount of a registered tartan unless there has been an error in the original recording.

You must indemnify the Keeper of any liability to meet damages or expenses incurred as a result of or in connection with the amendment request.

Where a request is accepted, the Keeper will determine whether or how the entry is to be amended and amend it accordingly.

The Keeper may amend an entry in the Register to correct typographical, clerical or other administrative error(s) at any time. Where such an amendment is made the Keeper may inform such persons as he considers appropriate and may issue an amended certificate of registration.

Refusal of a request to amend a tartan registered since 5 February 2009

The Keeper must refuse a request to amend an entry on the Register if:

  • Any of the above requirements have not been met.
  • The amendment requested will change the threadcount and therefore result in a new tartan design.
  • The amendment will result in the tartan failing to meet the criteria for registration.
  • The request gives rise to a question that should be resolved or clarified elsewhere, eg in a court of law.

If your request is refused, the Keeper will notify you of his decision in writing, including the reasons for his refusal.

Requesting the amendment of or raising a dispute regarding a tartan recorded by the STS, STWR or STA prior to 5 February 2009

To request an amendment of or raise a dispute regarding an entry on the Register for a tartan recorded prior to 5 February 2009 you will need to email or write to the Keeper of the Tartan Register at the address given above. In your email you need to specify the tartan entry concerned, the amendment or correction required and the reason why.

If you are the owner or original registrant of the tartan for which you are requesting an amendment, please include a copy of your original STS, STWR or STA certificate.

If you are not the owner or original registrant, you may still request an amendment. Your request will be considered by the Keeper and may be referred to the original recording body.

Refusal of a request to amend a tartan recorded by the STS, STWR or STA prior to 5 February 2009

The Keeper may refuse a request for an amendment if:

  • Any of the above requirements have not been met.
  • The amendment cannot be agreed with the person responsible for the content of the entry ie the owner or recorder of the tartan.
  • The amendment will result in the tartan failing to meet the criteria for registration.
  • The request gives rise to a question that should be resolved or clarified elsewhere, eg in a court of law.

If your request is refused, the Keeper will notify you of his decision in writing, including the reasons for his refusal.
